Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Sparkl ("Sparkl", "we", "us") governing your use of the Sparkl mobile application and the website at sparkl.gg (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms.

1. Acceptance & eligibility

By accessing or using the Service, you confirm that you can form a binding contract with us and that you are at least 13 years old (or the minimum age of digital consent in your country, if higher). If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. The Service

Sparkl helps trading-card-game collectors scan and identify cards, organize a collection, track its estimated value over time, build decks and binders, and set wishlist price alerts. We may add, change, or remove features at any time. We strive to keep the Service available but do not guarantee it will be uninterrupted or error-free.

3. Valuations & market data — important

Estimated card values, price history, profit/loss figures, set-completion costs, sealed-product expected value, and similar figures shown in the Service are informational estimates only. They are derived from third-party market data and modeling, may be inaccurate, incomplete, or out of date, and are not appraisals, offers, guarantees of price, or financial, investment, or trading advice. Actual prices you can buy or sell at may differ significantly. You are solely responsible for any buying, selling, grading, or collecting decisions, and you should do your own research. Sparkl is not a marketplace and does not buy, sell, or broker cards.

4. Accounts

You may create an account using Sign in with Apple or Continue with Google. You are responsible for the activity under your account and for keeping access to it secure. Please provide accurate information and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions & purchases

Card scanning is free and unlimited. Sparkl also offers an optional paid "Pro" subscription with additional features. Subscriptions are sold and billed through the Apple App Store and are subject to Apple's terms. Unless cancelled, subscriptions renew automatically at the then-current price; you can manage or cancel a subscription in your App Store account settings, and cancellation takes effect at the end of the current billing period. Except where required by law or Apple's policies, payments are non-refundable. Prices and plan features may change; we will give notice where required.

6. Acceptable use

You agree not to: (a) use the Service for any unlawful, infringing, or harmful purpose; (b) attempt to access, scrape, disrupt, or reverse-engineer the Service or its data except as permitted by law; (c) interfere with or overload our systems, or bypass usage limits or security measures; (d) resell or commercially exploit the Service or its market data without our permission; or (e) misrepresent your identity or infringe the rights of others.

7. Your content

You retain ownership of the data you add to the Service (such as your collection, binders, decks, notes, and preferences). You grant Sparkl a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process that content solely as needed to operate and improve the Service and provide it to you. You are responsible for your content and confirm you have the rights to provide it.

8. Intellectual property

The Service — including the Sparkl name, logo, software, design, and original content — is owned by Sparkl and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding. Trading-card names, images, set symbols, and related marks are the property of their respective rights holders and are displayed for identification and reference only. Market price data is provided by third parties and remains subject to their rights.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service, card identifications, or valuations will be accurate, reliable, uninterrupted, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Sparkl and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or collection value, arising out of or relating to your use of (or inability to use) the Service — even if advised of the possibility. To the extent liability cannot be excluded, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or fifty euros (€50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits rights that cannot be limited by law.

11. Indemnification

You agree to indemnify and hold harmless Sparkl and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (such as Valuations, Intellectual property, Disclaimers, Limitation of liability, and Governing law) will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of the European Union and the laws of the European Union member state in which Sparkl is established, without regard to conflict-of-laws principles. If you are a consumer, you also benefit from the mandatory provisions of the law of the country in which you reside, and you may bring proceedings in the courts of your country of residence. Nothing in this section limits your statutory consumer rights.
